Wilmington man pleads guilty to illegal possession of loaded firearm

A Wilmington man, Mustafa Darien Wescott, 24, has pleaded guilty to a federal firearm offense. The plea was accepted by Chief U.S. District Judge Colm F. Connolly on March 3, 2026.

Court records state that officers from the Wilmington Police Department approached Wescott in the Brandywine Village neighborhood on September 29, 2024. When officers told him to stop, Wescott ran away. During the chase, he took a loaded Ruger EC9S 9mm semi-automatic handgun from his pants pocket and threw it aside before surrendering to police. At that time, Wescott was not allowed to have a firearm due to several previous felony convictions.

Wescott admitted guilt for possessing a firearm as a prohibited person and could face up to 15 years in prison. However, sentences for federal crimes are often less than the maximum possible penalty. The final sentence will be decided by a federal district court judge after considering the U.S. Sentencing Guidelines and other legal factors. Sentencing is set for July 9, 2026.

The Bureau of Alcohol, Tobacco, Firearms and Explosives along with the Wilmington Police Department are handling the investigation.
